Unlikely Enemies: Urban Outfitters Vs. Navajo Nation

Popular retail chain Urban Outfitters may have to shell out millions of dollars due to a lawsuit filed against them by the Navajo Nation.

The lawsuit began in 2012 after the Navajo Nation claimed that Urban Outfitters products which bore the tribe’s “Navajo” name violated their federal and state trademark by falsely suggesting that the products were made by American Indians. Urban Outfitters have attempted to defend themselves by claiming that the word “Navajo” was used as a general term for an Aztec style.

Despite this, the Navajo Nation are demanding to be compensated for the use of the “Navajo” name in products which were sold from 2008. This vast amount of money can potentially reach millions of dollars. On Wednesday, Urban Outfitters angrily called upon the judge to limit the lawsuit to just products which were sold from when the lawsuit was filed in 2012 as they have been selling “Navajo” products since 2001. They argued that the tribe did not deserve anything from 2008 to when the lawsuit was filed due to the unreasonable delay in filing their claim. The judge has not yet made a ruling on the issue.
